An administrative law judge issued an initial determination in the International Trade Commission’s investigation of light-emitting diodes and products containing same (337-TA-784), finding that some of LG’s imports violate section 337 with respect to complainant OSRAM’s patents. The investigation was instituted in July 2011 to investigate whether imports of LG’s liquid crystal displays (LCDs) infringe OSRAM’s patents. While the administrative law judge said LG did not infringe one of OSRAM’s patents, it said LG’s products passed the three-part test of infringement, injury, and validity with respect to another of OSRAM’s patents. The ITC will now determine whether to review the initial determination.

The ITA also said it is rescinding this administrative review with respect to Xinchang Kaiyuan Automotive Bearing Co., Ltd. and Zhejiang Sihe Machine Co., Ltd. because they withdrew their requests for review, and said it will rescind the review for Tianshui Hailin in the final results for the same reason if the final results do not review the China-wide rate (Tianshui Hailin is part of the China-wide entity). These preliminary results are not in effect. The ITA may modify them in the final results of this review and change the estimated AD cash deposit rate for these companies.
