EchoStar "apparently cut a deal" with the FCC's Wireless Bureau for more time to complete Dish Network's 5G terrestrial network, yet the bureau lacked legal authority to grant that extension, VTel Wireless said this week in a docket 22-212 recon petition. VTel is seeking reconsideration of the bureau's September grant of extended milestone deadlines for the 5G network buildout (see 2409200049). EchoStar hasn't shown specific facts and circumstances that warrant a waiver, VTel argued.

Digital First Project Executive Director Nathan Leamer on Wednesday said whoever chairs the FCC during the next administration should take on a more forceful role in advocating for Congress to renew the commission’s lapsed spectrum auction authority. Leamer, who served as an aide to former FCC Chairman Ajit Pai, said during a Georgetown University Center for Business and Public Policy webcast that whichever party wins the White House Nov. 5 will reexamine broadband affordability issues. He believes the FCC will have to brace for the impact of potential federal court rulings striking down its recent orders reclassifying broadband as a Communications Act Title II service and instituting anti-digital discrimination rules.
A staunch opponent of giving FirstNet access to the 4.9 GHz band says the FCC decision to do that will head to court. The approved order, released Tuesday, said its aim is "more robust use" of the band, with FirstNet able to use unassigned spectrum in the band. Coalition for Emergency Response and Critical Infrastructure (CERCI) Chairman Kenneth Corey called the FCC order "unlawful, unnecessary, and an affront to public safety communications professionals across the country." He added, "This decision will be challenged and will be litigated."
SpaceX's claims that EchoStar's Dish Network's proposed terrestrial fixed wireless service can't coexist with Starlink operations in the lower 12 GHz band (see 2409040035) are "a textbook example of how to manipulate a technical analysis to reach a predetermined conclusion," EchoStar said Friday in docket 20-443. A SpaceX study randomly places fixed 5G base stations, ignoring that their location is the key to sharing, and its analysis "was designed to fail," EchoStar said. The SpaceX analysis assumes fixed 5G systems must operate constantly at full power, when they actually can dynamically adjust their power output. EchoStar also submitted a study simulating a denser distribution of Starlink terminals than SpaceX's analysis, but with EchoStar fixed 5G base stations deliberately placed to minimize interference. It said the results show coexistence without interference is "widely feasible." Consultancy RKF Engineering conducted EchoStar's study.
Addressing tribal issues is important, but it shouldn’t slow the rollout of the $9 billion 5G Fund that FCC commissioners approved in August, the Competitive Carriers Association said in comments posted Friday in docket 20-32. Commissioner Brendan Carr dissented on the 5G Fund item, which included a Further NPRM on tribal issues (see 2408290022). Tribes and their associations commented on the importance of cooperation with tribal governments (see 2410170045).
In talks with corporate governance lawyers, FCC Commissioner Nathan Simington has begun promoting how the FCC's cyber-trust mark could help reduce operations costs, making suppliers from trusted nations more competitive against Chinese suppliers. In an extensive interview with Communications Daily last month, Simington also discussed "smart and targeted" reforms of linear video distribution regulation (see 2409120059), his new practice of dissenting from monetary forfeitures (see 2409060054) and how he sees U.S. industrial policy in the context of China (see 2408200041). The Leech Lake Band of Ojibwe urged the FCC to increase the budget in Phase I of the 5G Fund, with a tribal set-aside, in a filing posted Thursday in docket 20-32. Commissioners approved a $9 billion fund in August on a 4-1 vote, with Commissioner Brendan Carr dissenting (see 2408290022). The Minnesota tribe also stressed tribal engagement. “Early engagement and inclusion is critical to reach 100% of … citizens residing in the Tribal lands,” the filing said.
Autos and trucks with built-in satellite-delivered connectivity will reach 30 million by 2034, ABI Research said Wednesday. Some Chinese original equipment manufacturers are shipping vehicles with the technology already, it added. Ubiquitous connectivity to drivers is a value proposition OEMs have lacked due to limits in cellular network coverage, but it provides a reliable after-sales revenue stream for OEMs. Satellite connectivity is particularly appealing in the U.S., China and the EU, given their strong markets for premium and SUV vehicles, it said. Collaboration between the European Space Agency, 5G Automotive Association and Third Generation Partnership Project will be key to unlocking satellite-connectivity capabilities.
GCI Communications filed a redacted letter at the FCC on its pursuit of a plan to pay for 5G deployment in Alaska (see 2407230013). GCI and the Brattle Group are developing a model that estimates the incremental cost of providing mobile broadband service to Alaska residents. “The results of the updated model continue to confirm that deploying 5G to all Broadband Serviceable Locations in Alaska at 35/3 Mbps (average) and 7/1 Mbps (edge) by the end of the Alaska Connect Fund term would require substantially more universal service support,” said a filing posted Wednesday in docket 23-238.
Having received FCC approval for 7,500 of its second-generation satellites in 2022 (see 2212010052), SpaceX is now asking the FCC to green-light 22,488 satellites the agency deferred on. Those additional satellites, plus "several small-but-meaningful updates" to the orbital configuration of the already-approved second-gen low earth orbit (LEO) satellites, would "improve space sustainability, better respond to evolving demand, and more efficiently share spectrum with other spectrum users," it told the FCC Space Bureau in an application posted Tuesday.
