The International Trade Commission published notices in the March 8 Federal Register on the following AD/CV injury, Section 337 patent or other trade proceedings (any notices that warrant a more detailed summary will be in another ITT article):
Peloton has filed a Section 337 complaint with the International Trade Commission over alleged patent violations by ICON Fitness. In the complaint, filed March 3, Peloton said that ICON is importing interactive fitness products including stationary bikes, treadmills, elliptical machines, and rowing machines that violate five of Peloton's patents. Peloton asked the ITC for a limited exclusion order and cease and desist orders. The ITC is seeking comments on public interest issues raised by the complaint in addition explanation of how the potential remedies would impact U.S. consumers. Written submissions are due by March 17.
The U.S. International Trade Commission opened a Section 337 investigation into alleged patent infringement of imported wet vacs, it said a notice released March 8. The ITC officially began the investigation March 3 following a Feb. 2 complaint by Bissel (see 2202070027). The complaint alleges that Tineco is importing wet dry surface cleaning devices, specifically the “iFloor” and “Floor One” models, that contain items infringing on five of Bissel's patents. Bissel asked the ITC for a permanent limited exclusion order and cease and desist orders.

The Commerce Department began administrative reviews for certain firms subject to antidumping and countervailing duty orders with January anniversary dates, it said in a notice released March 8. Producers and exporters subject to any of these administrative reviews on China must submit their separate rate certifications or applications by April 8 in order to avoid being assigned high China-wide rates.
The Commerce Department issued the final results of the antidumping duty administrative review on steel nails from China (A-570-909). These final results will be used to set final assessments of AD duties on importers for subject merchandise entered Aug. 1, 2019, through July 31, 2020.
The Commerce Department issued a notice to correct rates listed in a recent countervailing duty order on pentafluoroethane (R-125) from China (C-570-138) (see 2203020063). The March 3 order, issued at the same time as the antidumping duty order on R-125, incorrectly listed the applicable CV duty rates for the companies covered by the order, "due to a typographical error," the agency said March 8.

The Commerce Department released the preliminary results of its countervailing duty administrative review on fine denier polyester staple fiber from India (C-533-876). The agency calculated a CV rate of 5.82% for the only company under review, Reliance Industries Limited. Any changes to Reliance's cash deposit rate would take effect on the publication date of the final results of this review. In the final results, Commerce will also set assessment rates for subject merchandise from Reliance entered Jan. 1, 2020, through Dec. 31, 2020.
