The International Trade Commission has determined to review in part the final initial determination issued by the presiding administrative law judge, finding a violation of section 337 of the Tariff Act of 1930 in the investigation of certain inkjet ink cartridges with printheads and components thereof (337-TA-723). Specifically, the ITC has determined to review the finding that HP failed to establish by a preponderance of the evidence that Respondent Asia Pacific Microsystems, Inc. of Hsinchu City, Taiwan (APM) induced infringement of the asserted patents. The Commission has determined not to review any other issues in the ID.
The International Trade Administration is postponing the preliminary determination in the antidumping duty investigation of certain steel wheels from China (A-570-973), pursuant to a timely request by the petitioners. The ITA finds no compelling reason to deny the request; therefore, it is postponing the deadline for the preliminary determination by 50 days to October 26, 2011 (extended from September 6, 2011).

The International Trade Commission has voted to institute a section 337 patent-based investigation of certain light-emitting diodes (LEDs) and products containing same (337-TA-798), such as light fixtures and automotive lights. The investigation is based on a complaint filed by Samsung LED Co., Ltd., of Korea and Samsung LED America of Atlanta, GA, that alleges patent violations by OSRAM GmbH of Germany; OSRAM Opto Semiconductors GmbH of Germany; OSRAM Opto Semiconductors, Inc. of Sunnyvale, CA; and OSRAM Sylvania, Inc. of Danvers, MA.
The International Trade Administration has issued an affirmative final determination that certain cut-to-length carbon steel plate (CTL plate) products with 0.0008 percent or more boron, by weight, regardless of the producer, exporter or importer, are circumventing the antidumping duty order on CTL plate from China (A-570-849). As a result, such merchandise is being treated as subject to the AD order.
The International Trade Commission has made a determination in its five year sunset review of the antidumping duty order on polyethylene terephthalate (PET) film from Korea, concluding that revoking this order would not be likely to lead to a continuation or recurrence of material injury within a reasonable foreseeable time. As a result of this ITC negative determination, the existing order on imports of this product from Korea will be revoked.
