The International Trade Administration published notices in the Nov. 5 Federal Register on the following AD/CV proceedings (any notices that announce changes to AD/CV duty rates, scope, affected firms, or effective dates will be detailed in another ITT article):
The International Trade Administration issued the preliminary results of its administrative review of the antidumping duty order on certain preserved mushrooms from India (A-533-813) for one company, Agro Dutch Industries Limited. The ITA preliminarily determined that Agro Dutch failed to cooperate in the review, and so assigned it an adverse facts available (AFA) rate of 114.76 percent. According to the ITA's decision memo in the IAACCESS database, Agro Dutch declined to respond to one section of the ITA's initial questionnaire. These preliminary results are not in effect. The ITA may modify them in the final results of this review and change the estimated AD cash deposit rate for this company.
The International Trade Commission ended its Section 337 patent investigation of certain integrated circuits, chipsets, and products containing same including televisions (337-TA-822), because all parties agreed to termination. A previous ITC patent investigation of integrated circuits, chipsets, and products containing same (337-TA-786) had found a patent claim asserted by Freescale to be invalid due to obviousness. Because Freescale’s case in this investigation was also based on that patent claim, the company agreed to termination when it was requested by the respondents.
The International Trade Administration is giving advance notice that it and the International Trade Commission will consider revoking certain antidumping duty orders and suspension agreements in their automatic five-year sunset reviews, which are scheduled to begin in December. The ITA and ITC will consider revoking the following AD orders:
The International Trade Administration announced the opportunity to request administrative reviews by Nov. 30 for producers and exporters subject to 24 antidumping duty orders, and 4 countervailing duty orders, as well as one suspended antidumping duty investigation, with November anniversary dates. Affected products include lightweight thermal paper, diamond sawblades, steel flat products, etc.
A NAFTA panel will hear a challenge of the results of an antidumping new shipper review of seamless refined copper pipe and tube from Mexico (A-201-838), said the International Trade Administration. Mexico-based GD Affiliates, which formed part of the entity investigated in the ITA proceeding, requested the panel review. The collective entity, Golden Dragon, was assigned an AD rate of 5.53 percent by the ITA.
The International Trade Administration and the International Trade Commission initiated the five-year Sunset Reviews of the antidumping duty orders on hot-rolled carbon steel flat products from China (A-570-865), India (A-533-820), Indonesia (A-560-812), Taiwan (A-583-835), Thailand (A-549-817), and Ukraine (A-823-811); and the countervailing duty orders on hot-rolled carbon steel flat products from India (C-533-821), Indonesia (C-560-813), and Thailand (C-549-818).

The International Trade Administration is tolling all Import Administration deadlines for two days as a result of the closure during Hurricane Sandy, it said in a memo dated Oct. 31. The day on which any submission to the Import Administration is due should be calculated under the regulations as usual, except with the addition of two days (including weekends and holidays), it said.
