CBP issued a CSMS message to remind those filing ACE ABI In-Bond transactions that they must nominate themselves as a secondary notify party in the transaction. If the carrier has not nominated the filer, a failure to nominate oneself will mean the filer will not receive any of the subsequent status notifications related to the in-bond filing, said CBP.

CBP won't be giving any extensions to the Sept. 29 deadline for the required transition to ACE M1 for transmitting advance rail and sea cargo information, it said in a message reminding the trade of the coming change. As of Oct. 1, ACS/AMS EDI Ocean Manifest functionality will be transitioned to ACE as part of the ACE M1 Ocean and Rail Deployment. When this transition takes place, Ocean Manifest users will no longer be able to transmit or receive data via ACS/AMS. Programming changes to comply with the modified record formats must be made in order to continue filing manifests electronically. Any transactions not conforming to the ACE message formats will be rejected.

Movement on legislation reauthorizing CBP before the Presidential election remains largely uncertain, as the window for introduction gets smaller and smaller, said the lobbyist representing the National Customs Brokers and Forwarders Association of America (NCBFAA). With most legislation likely drafted, there's still a possibility of a bill's introduction this week, said Jon Kent, of Kent and O'Connor, who represents the NCBFAA on the Hill. The House is in session through Sept. 21, after which it's on recess through Nov. 13.

CBP fixed a problem with the ACE portal that was affecting user sign-on and the portal is now available, it said by CSMS message.

More than 52 percent of European companies believe it has become more risky to do international business over the last five years, and 95% say their own company has become more concerned about multinational and export risk, said a report by ACE Group. The report said the four key risk factors are disruption from catastrophes (42%), financial crises (38%), greater dependency on overseas earnings (37%), and international terrorist events (33%).

CBP won't go through with plans for a pilot that would waive local broker permitting requirements, said Elena Ryan, CBP's acting director, Trade Facilitation and Administration. Ryan spoke on a panel on rewriting broker regulations at the National Customs Brokers and Forwarders Association of America (NCBFAA) Sept. 10. CBP previously said it was considering a pilot program that would waive the requirement to maintain a place of business within the district where customs business is being conducted.
