Lacey Act declarations will be required in ACE for entries subject to the Animal and Plant Health Inspection Service’s sixth phase of enforcement beginning Oct. 1, even though tariff flags might not immediately be in place for the relevant subheadings, an APHIS official said during CBP’s biweekly call with ACE software developers on Sept. 30.

Protest filings at CBP would be best submitted through spreadsheets uploaded to the ACE protest module, CBP said in a CSMS message. The number of protests have increased steadily over the last two years and CBP said filing spreadsheets would "assist CBP with processing protests." While not required, "CBP highly recommends that the trade community submit a spreadsheet to assist CBP," it said. Including a "spreadsheet containing the entry and entry line changes for a protest is a best practice allowing a more streamlined process to review and decide protests," the agency said.
The Environmental Protection Agency on Sept. 23 released a final rule that sets a quota system for imports of hydrofluorocarbons that will eventually reduce imports of the greenhouse gases by 85 percent by 2036. The new regulations provide for company-specific allocations of allowances to import HFCs in 2022 and 2023, with allowances after that to be set in a future Federal Register notice. EPA intends to issue 2022 allowances by Oct. 1, it said in the final rule, which has yet to be scheduled for publication.
