Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., +CBP).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Always use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted (multi-word) term, you want to only include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

New CBP Guide Details Use of Forms 28, 29 and 4647 in ACE

CBP on April 22 released a new “quick reference guide” on the use of modernized CBP forms 28 (Request for Information), 29 (Notice of Action) and 4647 (Notice to Mark and/or Notice to Redeliver) in ACE. The guide includes instructions on accessing forms through modernized ACE and responding to a CBP Form 28, Form 29 or Form 4647.

Some Reinstated Section 301 Exclusions Not Available in ACE Until April 26, CBP Says

Functionality for five reinstated Section 301 exclusions in ACE will not be available until April 26, CBP said in a CSMS message. Due to an error in programming, ACE is still not permitting the filing of Chapter 99 duty or exclusion subheadings for tariff schedule numbers 0505.10.0050, 8412.21.0045, 8483.50.9040, 8525.60.1010 and 8607.21.1000, CBP said. Importers that entered goods subject to Section 301 tariffs under those five subheadings on or after April 12 without an associated Chapter 99 Section 301 subheading should file a post-summary correction once ACE filing capabilities are restored for the subheadings April 26, CBP said.

District Court Stops Non-Vessel Carrier From Shipping Nike Goods After Trademark Infringement Case

Two companies that arrange for the shipment of goods with vessel operating carriers, Shine Shipping and Shine International (Shine), will no longer be able to import, export, transport, offer for sale, sell or assist any such activity, for any goods bearing Nike trademarks, the U.S. District Court for the Southern District of New York said. Wrapping up a trademark infringement case, the district court released the terms of the stipulated permanent injunction and final order against Shine, including orders to verify every shipment to the U.S. with either the foreign shipper, importer or foreign freight forwarder (Nike v. B&H Customs Services, S.D.N.Y. #20-01214).

Some Section 301 Exclusions Not Available in ACE Until April 17

The reinstated Section 301 tariff exclusions for subheading 8536.50.9065 won't be available in ACE until April 17, CBP said in a CSMS message. Those exclusions in "classification 9903.88.67 will be available in the Automated Commercial Environment (ACE) on April 17," it said. The agency message is an update to a previous message that said reinstated exclusions would be available in ACE April 12 (see 2204050068).
