The Alcohol and Tobacco Tax and Trade Bureau is setting new procedures for claiming Craft Beverage Modernization Act tax reductions beginning in 2023. The agency’s temporary rule implements the transfer of authority to administer CBMA provisions from CBP to TTB, and creates a new system wherein importers will claim refunds retroactively each quarter, rather than at time of entry. Producer registration, assignment of credits and importer claims will all be filed in the agency’s myTTB online system and tied to data filed in ACE at entry.

CBP added a new set of frequently asked questions to its ACE FAQ webpage on upcoming capabilities for ocean house bill of lading release, it said in a Sept. 15 CSMS message. “CBP will periodically update this section with new content as we approach the deployment of the OHBOL Release ACE enhancement,” the agency said. The capability is scheduled for deployment in the ACE production environment Jan. 8.
FDA released on Sept. 13 a draft of a new version of its draft guidance on prior notice for imported food. Version 4 of the industry guidance would replace the previous version finalized in 2016, adding additional information on the effect of systems recognition or equivalency determinations on prior notice requirements and the timeframe for making requests for FDA review of a refusal or hold for inadequate prior notice. Comments on the draft changes are due Nov. 14.
