Hikvision Challenges FCC's Gear Authorization Order at DC Circuit

Hikvision USA has asked the U.S. Court of Appeals for the D.C. Circuit to review an FCC order seeking to close potential loopholes in the agency's equipment authorization process (see 2510280024). The company criticized the order after it was approved in October.

The order was part of the FCC’s ongoing move to clamp down on Chinese companies' participation in the U.S. communications market. Hikvision USA’s parent is China’s Hangzhou Hikvision Digital Technology Co.

The order “exceeds the FCC’s jurisdiction and its statutory authority; violates the Due Process and Equal Protection Clauses of the United States Constitution and is otherwise unconstitutional,” said a petition filed last week at the D.C. Circuit.
