DSB Adopts Compliance Panel Finding in Dispute on Colombian Frozen Fries Duties

World Trade Organization members adopted a compliance panel report in a dispute on Colombia's antidumping duties on frozen fries from Belgium, Germany and the Netherlands during the Nov. 24 meeting of the Dispute Settlement Body.

Last month, the panel found Colombia failed to fully comply with an earlier dispute panel ruling and an arbitral award issued "in accordance with the Multi-Party Interim Appeal Arbitration Agreement" (see 2510270046). The compliance panel said the EU established that Colombia "acted inconsistently" with its obligations when deciding to compare a weighted average export price with a simple average of "intermediate weighted average normal values" in the AD proceeding (see 2510270046).

During the DSB meeting, the EU urged Colombia to take "immediate action to comply with the ruling." Colombia said it disagreed with the findings in the original dispute panel report and in the compliance proceedings but that it would comply with the findings.

The DSB chair also announced that two items were removed from the meeting agenda: adoption of the panel ruling in the request from Indonesia for the adoption of the panel ruling in the dispute on the EU's AD/CVD on Indonesian stainless steel cold-rolled flat products, and the EU's request for DSB authorization to impose countermeasures on U.S. imports following an arbitrator's decision in a spat on U.S. AD/CVD on Spanish ripe olives. Indonesia's request was removed after the EU decided to appeal the ruling.
