Ecommerce Alliance: Quiet Hour Concerns Not Going Away
The Ecommerce Innovation Alliance updated the FCC last week on its request for a declaratory ruling that people who provide prior express written consent to receive text messages can't claim damages under the Telephone Consumer Protection Act for those received outside the hours of 8 a.m. to 9 p.m. (see 2503030036).

In a filing in docket 02-278 Thursday, “the one-year anniversary of the initial wave of frivolous quiet hours litigation,” the group said the evidence “demonstrates that continued regulatory action is necessary as current practices are fueling a crisis inflicting measurable harm on law-abiding businesses across the e-commerce and retail sectors.”
