More Importers Challenge IEEPA Tariffs, Seek Refunds at Trade Court

Two importers, SAM HPRP Chemicals, dba SAM Nutrition, and Zak Designs, filed identical complaints at the trade court Nov. 14 challenging President Donald Trump’s use of the International Emergency Economic Powers Act to impose global tariffs (Zak Designs v. U.S. Customs and Border Protection, CIT # 25-00266) (SAM HPRP Chemicals Inc. v. U.S. Customs and Border Protection, CIT # 25-00267).

They said that, although they know the Supreme Court is currently hearing V.O.S. Selections, their own actions are necessary because “importers that have paid IEEPA duties, including Plaintiff, are not guaranteed a refund for those unlawfully collected tariffs in the absence of their own judgment and judicial relief.”

SAM Nutrition and Zak Designs have paid preliminary duties for the IEEPA tariffs “on a continuous basis,” they said. They asked the trade court to find that the duties had been unlawfully imposed and to order a refund.
