Neal Katyal to Argue for Importers at SCOTUS Tariff Hearing
Neal Katyal, partner at Milbank, will argue at the Supreme Court on behalf of the private parties during the Nov. 5 hearing on the legality of tariffs imposed under the International Emergency Economic Powers Act, a representative of the parties confirmed (Donald J. Trump v. V.O.S. Selections, U.S. 25-250) (Learning Resources v. Donald J. Trump, U.S. 24-1287).

Last week, the high court gave the 12 U.S. states 20 minutes to make their case and two separate groups of importers, one represented by Akin and the other by the Liberty Justice Center, 20 minutes to argue the issues (see 2508070055). Before the U.S. Court of Appeals for the Federal Circuit, Katyal argued on behalf of the importers represented by the Liberty Justice Center, led by V.O.S. Selections, while at the U.S. District Court for the District of Columbia, the importers led by Learning Resources were represented by Pratik Shah, partner at Akin.
The two groups of importers agreed that Katyal would represent both of them during their allowed 20 minutes of argument. Learning Resources CEO Rick Woldenberg told us the decision was decided by a coin flip. Katyal served as acting solicitor general during the Obama administration and has argued more than 50 cases at the Supreme Court.
