EU Prevails in Compliance Action Against Colombia's Antidumping Duties on Frozen Fries
A World Trade Organization dispute settlement panel found last week that Colombia has failed to comply with the findings of an arbitration panel regarding the nation's antidumping duties on frozen fries from Belgium, Germany and the Netherlands.

Issuing a compliance panel report on Oct. 23, the dispute panel said the EU established that Colombia "acted inconsistently" with its obligations when deciding to compare a weighted average export price with a simple average of "intermediate weighted average normal values" in the AD proceeding. The panel also said the EU properly established that Colombia improperly imposed AD "at a rate that is higher than the dumping margin."
The EU opened the compliance proceedings against Colombia in May after the bloc prevailed in front of both a dispute settlement panel and an arbitral tribunal assembled under the WTO's Multi-Party Interim Appeal Arbitration Agreement, which the parties used in lieu of a functioning Appellate Body (see 2405310019).
The EU applauded the compliance finding. "Colombia will need to take swift action to rectify the situation and repeal the illegal measures without delay," it said.
