ITC Begins Second Section 337 Enforcement Proceeding on 4 Chocolate Milk Powder Importers

The International Trade Commission is beginning yet another formal enforcement proceeding to investigate allegations that four companies are still importing patent-infringing chocolate milk powder (ITC Inv. No. 337-TA-1232) in violation of an ITC general exclusion order and cease and desist orders, the commission said in a notice to be published April 1.

This is the second time that complainant Meenaxi has told the ITC that the four respondents -- Organic Ingredients, New India, Bharat Bazar and Coconut Hill – continue to import chocolate milk powder that infringes its patents, despite a GEO issued in December 2022 (see 2311160078) and CDOs issued in 2024 (see 2411220030) after the respondents violated the GEO.
