Commerce Rescinds 2019 Administrative Review of Dominican Aluminum Exporter
In remand results released March 4, the Commerce Department rescinded a 2019 administrative review of a countervailing duty order with regard to Dominican aluminum extrusion exporter Kingtom Aluminio (Kingtom Aluminio v. United States, CIT # 22-00079)

It said the proceeding was remanded to it so that the department could consider it in light of the holdings in Global Aluminum Distrib. v. United States and H&E Home, Inc. v. United States, both of which upheld CBP in reversing an affirmative evasion finding regarding Kingtom.
The administrative review Commerce rescinded was considering aluminum extrusions from China, the department said in its remand results. CBP initially recategorized Kingtom’s 2019 entries as type 03 on the basis of those evasion rulings, but, with the reversals, that basis “no longer exists,” it said.
As a result, it said it accepted Kingtom’s "No Shipments Letter" and held that none of the exporter’s goods were subject to antidumping and countervailing duty orders.
