ITC Begins Section 337 Investigation on Women's Flats

The International Trade Commission is beginning a Section 337 investigation on certain women’s flats with colored outsoles thereof (ITC Inv. No. 337-TA-1428), after receiving allegations filed by Gavrieli Brands that 13 companies are importing women’s flats that violate its design patents and trade dress, the agency said in a Dec. 12 news release.

In a complaint filed in November (see 2411190047), Gavrieli said that Kijera’s OneDrop in New York, Craze in the Philippines, and 11 Chinese companies are importing infringing women's flats with "a blue outsole on footwear," in violation of its trade dress. The ITC will consider a general exclusion order or, in the alternative, a limited exclusion order, and cease and desist orders.
