Apple to Stop Sales of Some Apple Watches as Section 337 Exclusion Order Takes Effect

Apple will stop sales of two of its models of the Apple Watch in the coming days, in advance of a Section 337 exclusion order taking effect following the expiration of a 60-day presidential review period. Apple referred us to a statement, in which it said it will stop sales of the Apple Watch Series 9 and Ultra 2 from its website starting Dec. 21, and from Apple retail locations after Dec. 24. The presidential review period ends Dec. 25.

The ITC issued the limited exclusion order and cease and desist orders in late October, after finding in a Section 337 investigation that the Apple Watches infringe on patents held by Masimo Corporation and Cercacor Laboratories related to the watches’ light-based blood pulse oximetry function.

"Apple strongly disagrees with the order and is pursuing a range of legal and technical options to ensure that Apple Watch is available to customers,” Apple said in the statement.

“Should the order stand, Apple will continue to take all measures to return Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the U.S. as soon as possible,” Apple said.
