China Wood Flooring: Amended Final Results of AD Admin Review
The Commerce Department is amending the final results of an antidumping duty administrative review on multilayered wood flooring from China (A-570-970) based on the final decision in a court case challenging those final results. Commerce calculated a revised AD rate for Jinlong of 2.05%, and assigned that rate to the non-individually examined companies that qualified for a separate rate. Jinlong and the separate rate companies had originally received a zero percent rate in the final results. The zero percent rate from the final results won't change for Jiangsu Guyu International Trading Co., Ltd. All new rates are applicable Nov. 9, 2023.

Jinlong includes: Dalian Qianqiu Wooden Product Co., Ltd., Fusong Jinlong Wooden Group Co., Ltd., Fusong Jinqiu Wooden Product Co., Ltd., and Fusong Qianqiu Wooden Product Co., Ltd.
Because Jinlong, Guyu and all but seven of the separate rate respondents have a superseding cash deposit rate, i.e., there have been final results published in a subsequent administrative review, Commerce will not issue revised cash deposit instructions to CBP, and the current cash deposit rate for these companies won't change (see 2306290073). See the Appendix in the notice for a list of the applicable separate rate respondents.
For the seven separate rate respondents without a superseding cash deposit rate -- Anhui Longhua Bamboo Product Co., Ltd.; Dalian Deerfu Wooden Product Co., Ltd.; Dalian Shengyu Science And Technology Development Co., Ltd.; Dunhua City Wanrong Wood Industry Co., Ltd.; Power Dekor Group Co., Ltd.; Yekalon Industry Inc.; and Zhejiang Shiyou Timber Co., Ltd. -- Commerce will issue revised cash deposit instructions to CBP.
The notice also said that Commerce remains, at this time, "enjoined by [court] order from liquidating entries that: were exported by Jinlong, Guyu, and the non-individually-examined separate rate respondents listed in the Appendix, and were entered, or withdrawn from warehouse, for consumption during the period December 1, 2017, through November 30, 2018. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
