Paper File Folders: Prelim AD Cash Deposit Rates Take Effect for China, India, Vietnam
The Commerce Department made preliminary affirmative antidumping determinations that paper file folders from China (A-570-147), India (A-533-910) and Vietnam (A-552-834) are being sold at less than fair value. The agency will impose antidumping duty cash requirements on entries of subject merchandise beginning on May 17, the scheduled publication date of these preliminary determinations in the Federal Register.

Paper file folders from India are also already subject to suspension of liquidation and countervailing duty cash deposit requirements that took effect March 20 (see 2303170013), with CV duty rates ranging from 3.65% to 59.26%.
Scope Changes Include New Exclusion for All Binders, Folders
Commerce made changes to the scope of these AD/CVD investigations in response to comments from the original petitioners that they have no interest in covering any binders or folders under the scope of the investigations or potential orders. The agency is adding the following new exemption to the list of exemptions in the scope:
- Binders consisting of a front cover, back cover, and spine, with or without a flap; to be excluded, a mechanism with two or more metal rings must be included on or adjacent to the interior spine.
Commerce is also modifying an existing exemption for folders to remove a requirement that the folders must be of an expanding type to qualify, as follows:
- folders that have an outer surface (other than the gusset, handles, and/or closing mechanisms, if any) that is covered entirely with fabric, leather, and/or faux leather.
Commerce is also amending a scope exemption for fashion folders to remove language that had said printed or foil stamped letters or numbers don't qualify as folders for the exemption, and to correct punctuation requested by the petitioner. The new scope language for the exemption is as follows:
- fashion folders, which are defined as folders with all of the following characteristics: (1) plastic lamination covering the entire exterior of the folder, (2) printing, foil stamping, embossing (i.e., raised relief patterns that are recessed on the opposite side), and/or debossing (i.e., recessed relief patterns that are raised on the opposite side), covering the entire exterior surface area of the folder, (3) at least two visible and printed or foil stamped colors (other than the color of the base paper), each of which separately covers no less than 10 percent of the entire exterior surface area, and (4) patterns, pictures, designs, or artwork covering no less than thirty percent of the exterior surface area of the folder.
​AD Suspension of Liquidation and Cash Deposit Requirements
Commerce will instruct CBP to suspend liquidation for all entries of subject merchandise from China and Vietnam (liquidation for India is already suspended) that are entered, or withdrawn from warehouse, for consumption on or after May 16, and require AD duty cash deposits as follows:
