ITC Issues Limited Exclusion Order on Exercise Equipment With Video Streaming
Fitness devices with streaming video components that infringe on three patents held by Dish have been barred from entry via a limited exclusion order issued, the International Trade Commission said in a notice (ITC Inv. No. 337-TA-1265). Infringing equipment manufactured by or on behalf of respondents Icon Health & Fitness, FreeMotion Fitness, NordicTrack, Peloton Interactive, or any of their affiliated companies, falls within the exclusion order, according to the commission's March 8 decision.

That decision upheld most of Chief Administrative Law Judge Clark Cheney's September initial final determination, which found the respondents had violated Section 337 with respect to the three patents still at issue. The ITC initiated the investigation in May 2021 following a complaint by Dish, which alleged infringement of five of its patents. Two patents were dropped over the course of the investigation.
The ITC also issued cease and desist orders against iFit and Peloton and included an exemption for repair or replacement of products purchased by consumers prior to the date of the remedial orders. The ITC imposed a bond of zero percent on the covered products during the period of presidential review.
