South Korea Heavy Rectangular Pipe: Amended Final Results of AD Admin Review
The Commerce Department is amending the final results of an antidumping duty administrative review on heavy walled rectangular welded carbon steel pipes and tubes from South Korea (A-580-880) to align dumping margins assigned to HiSteel Co., Ltd. and Kukje Steel Co., Ltd. with the final decision in a court case challenging those final results. In the final results of the AD review (see 2007090021), covering the period Sept. 1, 2017, through Aug. 31, 2018, Commerce assigned HiSteel a 26.2% dumping margin and Kukje, 35.11%. Based on the judgment in the Nov. 23, 2022, court decision, Commerce calculated revised weighted-average dumping margins for HiSteel and Kukje of 9.90% and 1.91%, respectively, applicable Dec. 3, 2022.

Because HiSteel and Kukje have a superseding cash deposit rate, i.e., there have been final results published in a subsequent administrative review, Commerce will not issue revised cash deposit instructions to CBP, and the current cash deposit rate will not change (see 2204060037).
The notice also said that Commerce remains, at this time, enjoined by court order from liquidating entries "that were produced and/or exported by HiSteel Co., Ltd. or Kukje Steel Co., Ltd. and were entered, or withdrawn from warehouse, for consumption during the period September 1, 2017, through August 31, 2018. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
