CIT Upholds Parts, Sends Back Parts of AD Case on Cambodian Mattresses in Confidential Order
The Court of International Trade in a confidential Feb. 17 order partially granted the U.S. motion to dismiss an antidumping duty case brought by Cambodian mattress makers. In the order, Judge Gary Katzmann also partially granted a motion for judgment from the plaintiffs, led by Best Mattresses International Co. Katzmann gave the litigants until Feb. 23 to review the opinion for confidential information (Best Mattresses International Co. v. United States, CIT Consol. # 21-00281).

The case deals with the AD order on mattresses from Cambodia in which Best Mattresses and Rose Lion Furntirue Co. served as the two mandatory respondents. The plaintiffs are challenging, among other things, Commerce's use of the differential pricing analysis to detect masked dumping -- a practice that was called into question by the U.S. Court of Appeals for the Federal Circuit in a July 2021 opinion (see 2107150032).
