ITC Seeks Public Comments on Section 337 Case on Automotive Lamps

The International Trade Commission is soliciting submissions on public interest issues raised by the recommended relief should the Commission find a violation a Section 337 case on imported automotive lamps (ITC Inv. No. 337-TA-1291), according to a notice set to be published in the Jan. 30 Federal Register. The commission is considering a limited exclusion order against certain replacement automotive lamps from TYC Brother Industrial, Genera Corporation (doing business as TYC Genera), LKQ Corporation and Keystone Automotive Industries. Comments are due by close of business on Feb. 23.

The investigation began with a December 2021 complaint by Kia that accused the four respondents of infringing on 20 of Kia's design patents concerning automotive lights. On Jan. 24, 2023, Administrative Law Judge Brian Moore found that 16 of the patents were infringed upon and recommended a limited exclusion order on automotive lights imported by the four respondents.

The ITC is seeking comments that explain how the lamps are used in the U.S. that identify any public health, safety or welfare concerns related to the recommended order, that identify products that could replace the lamps if they are excluded, that indicate whether suppliers have the capacity to replace the volume of articles potentially excluded, and that explain how the recommended order would impact U.S. consumers.
