Canada Softwood Lumber: Another Amendment to Final Results of CVD Admin Review

The Commerce Department is again amending its previously amended (see 2210200072) final results of a countervailing duty administrative review on softwood lumber products from Canada (C-122-858) to correct a ministerial error in listing companies under review for the period of calendar year 2020. It said Brink Forest Products Ltd.; Deep Cove Forest Products, Inc.; and Vanderhoof Specialty Wood Products Ltd. should have been included in the initiation notice, indicating they were part of the review. Commerce subsequently omitted those same companies from Appendix II of the original final results, where they should have been listed as being among the firms subject to the review that received the subsidy rate applicable to companies not selected for individual examination.

Brink Forest Products and Vanderhoof Specialty Wood Products were not selected for individual review, and received the CV duty cash deposit rate of 3.83%, effective Aug. 9 (see 2208090019), Commerce said. Commerce also said in the current amendment that although Deep Cove Forest Products should have been on the list in the initiation notice, the company will not be subject to the assessment and cash deposit rates covering the 2020 review period because it had no shipments of subject merchandise.

Commerce said it intends to issue suspension instructions for Brink Forest Products and Vanderhoof Specialty Wood Products, consistent with a suspension of liquidation request that has been filed. And Commerce will instruct CBP to collect cash deposits for Brink Forest Products and Vanderhoof Specialty Wood Products as companies subject to the review, at the 3.83% rate.

Commerce earlier had amended the final results to show that five additional companies should have appeared in an appendix list in the final results that named companies not selected for individual examination (see 2210110045).
