CBP to Require Broker Employee Lists by Feb. 17; Reporting Unavailable in Portal This Week

Customs brokers must submit and maintain a current list of employees to CBP by Feb. 17 to comply with recent changes under the broker modernization final rule, CBP said in a CSMS message. Under the final rule, which took effect Dec. 19 (see 2210170071), “brokers must submit a list of names of persons currently employed and, after initial submission, update the list if any of the required information changes,” CBP said.

Brokers with an ACE portal account will have to maintain current employee information in the ACE portal, CBP said. “Brokers are reminded to validate employee information transferred from the local permits to the national permit in ACE to ensure all information is up-to-date and accurate no later than February 17, 2023,” the agency said.

Brokers without an ACE portal account and who have previously reported their employees in writing to the district permitting port location must submit a current list of employees to the processing Center of Excellence and Expertise by Feb. 17, CBP said.

The final rule also requires that brokers submit new employee and terminated employee information to CBP within 30 days of employment and termination, but that feature will be unavailable in the ACE portal this week while CBP transfers employee information from district to national permits, CBP said in the same message. Brokers may still satisfy the requirement by providing the information in writing to the processing Center for Excellence and Expertise, CBP said.

CBP on Dec. 16 released two illustrated how-tos on how to access the ACE portal for brokers, as well as on broker reporting in the portal. The latter document includes information on bulk employee data reporting, single employee data reporting, and how to create a designated recordkeeping contact and customs business point of contact.
