UAE Circular Welded Pipe: Commerce Again Amends Final Results of AD Admin Review
The Commerce Department is amending the amended final results of its antidumping duty administrative review on circular welded carbon-quality steel pipe from the United Arab Emirates (A-520-807) for entries in 2017-2018, to align results with a final judgment, issued Dec. 8, in a court case that challenged the rates from the final results. The amendment is to the dumping margin assigned to Universal Tube and Plastic Industries, Ltd. (UTP)/THL Tube and Pipe Industries LLC (THL)/KHK Scaffolding and Formwork LLC (KHK) (collectively, Universal).

Commerce also said that the results announced in the notice, effective Dec. 18, will not affect the current cash deposit rate for Universal, as there have been final results published in a subsequent administrative review that supersede the amended results. Universal's current rate is 3.54%, effective July 11 with final results in the AD administrative review for subject merchandise entered Dec. 1, 2019, through Nov. 30, 2020 (see 2207080048).
The final results had an AD rate for Universal at 3.79%, and that rate fell to 3.63% when a calculation error was corrected and amended results were published, effective Jan. 5, 2021. Now that the court case judgment has been released, Commerce is again revising the AD rate for Universal to align with that in the court decision, which is 1.18%.
Commerce said it remains enjoined by the trade court order "from liquidating entries that: were produced and exported by Universal, and were entered, or withdrawn from warehouse, for consumption during the period December 1, 2017, through November 30, 2018. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
