China Narrow Woven Ribbons: Commerce Amends Final Results of 2016 CVD Admin Review
The Commerce Department is amending the final results of its countervailing duty administrative review on narrow woven ribbons with woven selvedge (C-570-953) from China for entries during calendar year 2016, to align results with a final judgment, issued Dec. 8, in a court case that challenged the rates from the final results. The amendment is to the countervailable subsidy rate assigned to Yama Ribbons and Bows Co.

Commerce also said that the results announced in the notice, effective Dec. 18, will not affect the current cash deposit rate for Yama, as there have been final results published in a subsequent administrative review that supersede the amended results. Yama's current rate is 176.95%, effective Sept. 14 with the final results in the CVD administrative review for subject merchandise entered Jan. 1, 2020, through Dec. 31, 2020 (see 2209140037).
The final results for subject merchandise entered Jan. 1, 2016, through Dec. 31, 2016, had a CVD rate for Yama at 23.7%. Now that the court case judgment has been released, Commerce is revising the CVD rate for Yama to align with that in the court decision, which is 13.16% for the 2016 review.
Commerce said it remains enjoined by the trade court order "from liquidating entries that were produced and exported by Yama and were entered, or withdrawn from warehouse, for consumption during the period January 1, 2016, through December 31, 2016. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
