South Korea OCTG: Amended Final Results of 2 AD Admin Reviews

The Commerce Department is amending the final results of two separate antidumping duty administrative reviews on certain oil country tubular goods (OCTG) from South Korea (A-580-870) to align dumping margins assigned to Nexteel and SeAH Steel Corporation, and the non-individually examined companies, in one review, and SeAH Steel in the other review, based on the results of two court cases challenging those final results.

In the final results of the first review, covering the period Sept. 1, 2016, through Aug. 31, 2017, Commerce assigned Nexteel a 32.24% dumping margin, and SeAH 16.73%. The non-individually examined companies were assigned a 24.49% dumping margin.

The amendment for this review reflects a change in calculation method and results in Nexteel receiving a dumping margin of 9.77%, and SeAH 5.28%, with the non-individually examined companies' rate at 7.53%, aligning Commerce's results with those determined in the court case.

In the final results of the second review, covering the period Sept. 1, 2017, through Aug. 31, 2018, Commerce assigned SeAH a 3.96% dumping margin. SeAH challenged its own rate but not the other rates determined for other companies in that review.

The amendment for this review reflects a change in calculation method and results in SeAH receiving a dumping margin of zero, the same rate Hyundai Steel received in the original final results of this review, aligning Commerce's results with those determined in the court case.

The amended rates in each review, however, will not affect the current cash deposit rates assigned in the most recent final results of the AD administrative review of the subject merchandise (see 2204070053).

The first notice also said that Commerce remains, at this time, enjoined by court order from liquidating entries "that were produced and/or exported by NEXTEEL, SeAH, AJU Besteel, Husteel, ILJIN, and Hyundai Steel, and were entered, or withdrawn from warehouse, for consumption during the period September 1, 2016, through August 31, 2017. Liquidation of these entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."

The second notice also said that Commerce remains, at this time, enjoined by court order from liquidating entries "that were produced and exported by SeAH, and were entered, or withdrawn from warehouse, for consumption during the period September 1, 2017, through August 31, 2018. Liquidation of these entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
