South Korea Circular Welded Steel Pipe: Amended Final Results of AD Admin Review

The Commerce Department is amending the final results of an antidumping duty administrative review on circular welded non-alloy steel pipe from South Korea (A-580-809) to align dumping margins assigned to Hyundai Steel Company and SeAH Steel Corporation with results of a court case challenging those final results. In the final results of that review, covering the period Nov. 1, 2015, through Oct. 31, 2016, Commerce assigned Hyundai a 30.85% dumping margin, and SeAH 19.28%.

The amendment reflects a change in calculation method and results in Hyundai receiving a dumping margin of 12.92%, and SeAH 9.77%, aligning Commerce's results with those determined in the court case, but the change will not affect the current cash deposit rates assigned in the most recent final results (see 2205030012).

Since there have been final results published in a subsequent administrative review, Commerce said it will not issue revised cash deposit instructions to CBP.

The notice also said that Commerce remains, at this time, enjoined by court order from liquidating entries "that: (1) were produced by Hyundai Steel Company (also known as Hyundai Steel Corporation and Hyundai Steel and the successor-in-interest to Hyundai HYSCO) and exported by Hyundai Steel Company or Hyundai Corporation, and imported by Hyundai Steel USA, Inc. or Hyundai Corporation USA; or (2) were produced and/or exported by SeAH Steel Corporation; and were entered, or withdrawn from warehouse, for consumption during the period November 1, 2015, through October 31, 2016. These entries will remain enjoined pursuant to the terms of the injunctions during the pendency of any appeals process."
