Taiwan Steel Nails: Amended Final Results of AD Admin Review, but No New Current AD Rate

The Commerce Department is amending the final results of an antidumping duty administrative review on certain steel nails from Taiwan (A-583-854) to correct a duty calculation for PT Enterprise, Inc./Pro-Team Coil Nail Enterprise, Inc. and two companies not selected for individual examination in the review, Hor Liang Industrial Corp. and Romp Coil Nails Industries Inc. In the final results of that review, covering the period May 20, 2015, to June 30, 2016, Commerce assigned to the non-examined companies the dumping margin assigned to the mandatory respondent, 78.17%.

The amendment corrects the dumping margins to zero percent for PT Enterprise and 35.3% for the two non-examined companies, aligning Commerce's results with those determined in a court case over Commerce's final results in that review, but will not affect the current cash deposit rates -- 78.17% is the rate for all the companies affected -- assigned in the most recent final results (see 2011250010).

Since there have been final results published in a subsequent administrative review, Commerce said it will not issue revised cash deposit instructions to CBP.

The notice also said that Commerce remains, at this time, enjoined by court order from liquidating entries "that: were imported by PrimeSource Building Products, Inc.; produced and exported by Pro-Team Coil Nail Enterprise, Inc. and/or PT Enterprise Inc.; produced and exported by Hor Liang Industrial Corp. or Romp Coil Nails Industries Inc.; or produced and exported by Unicatch Industrial Co., Ltd., and were entered, or withdrawn from warehouse, for consumption during the period May 20, 2015 through June 30, 2016. Liquidation of these entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
