Taiwan Steel Nails: Prelim Results of AD Admin Review
The Commerce Department issued the preliminary results of its antidumping duty administrative review on steel nails from Taiwan (A-583-854). Rates calculated in this review will be used to set assessment rates for importers of subject merchandise from 69 exporters remaining in the review that was entered July 1, 2020, through June 30, 2021.

Only the exporters for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation “as entered” for entries during the period of review from all exporters for which a review was not requested or the request was withdrawn (AD/CVDWeb Message # 11285427).
Commerce said it is rescinding review of 59 of 128 companies originally requested for review because requests for review were withdrawn. See the Notice, Appendix III, for the list of all 59 companies for which the review was rescinded.
Additionally, Commerce said that Wiresmith Industrial Co., Ltd. and Create Trading Co., Ltd. -- both resellers of subject merchandise that reported that they had no reviewable sales or shipments during the review period -- were preliminarily determined to not be the first parties in the transaction chain and, thus, are not considered the exporters of subject merchandise during the review period for purposes of this review. So while Commerce's preliminary determination is of no shipments for the two companies during the review period, the agency said it will complete the review with the resellers included, and then issue appropriate instructions to CBP after completion of the review -- expected to be to liquidate any existing entries of subject merchandise produced and exported by the resellers’ respective unaffiliated suppliers at the all-others rate.
Cash Deposit Requirements
Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for the 69 companies remaining under review, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty rates:

Average Rate. Commerce is not individually investigating 59 companies subject to this review and instead preliminarily assigned them an average of the rates assigned to the only individually investigated companies. See Commerce's notice, Appendix II, for a full list of these 59 companies.
No Shipments. Commerce found four companies -- Astrotech Steels Private Limited, Geekay Wires Limited, Region Industries Co., Ltd., and Region System Sdn. Bhd. -- had no shipments to the U.S. during the period under review. If Commerce continues this finding in its final results, cash deposit requirements for these four companies will not change as a result of this review. Any entries under their case numbers will be liquidated at the 2.16% all others rate.
Assessment Rates
As part of this administrative review, Commerce will also calculate final AD duty assessments on importers of subject merchandise from the companies under review that was entered between July 1, 2020, and June 30, 2021. If these preliminary results are confirmed in the final results, AD duties on importers of subject merchandise entered during the period under review will be assessed at the rates listed above.
