China Mobile Access Equipment: Details of CV Duty Order, Refunds of Cash Deposits

The Commerce Department on Dec. 9 released a countervailing duty order on mobile access equipment from China (C-570-140). The order sets permanent countervailing duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will begin conducting annual administrative reviews, if requested, to determine final assessments of CV duties on importers and make changes to cash deposit rates.

Commerce is also conducting an antidumping duty investigation on mobile access equipment from China. The agency began requiring AD duty cash deposits in a preliminary determination issued in March (see 2103030029).

Cash Deposits Prior to Dec. 9 Refunded; Suspension of Liquidation Resumes

Commerce will order the refund of all CV duty cash deposits collected during this CV duty investigation, and will not assess CV duties, on mobile access equipment from China entered before Dec. 9, because the ITC found only the threat of injury to U.S. manufacturers, and not that injury actually occurred. As a result, no CV duties may be collected prior to publication of the ITC injury determination.

Suspension of liquidation and CV duty cash deposit requirements resume for all entries of subject merchandise entered on or after Dec. 9, the date that the final ITC affirmative injury determination was published.

Commerce will instruct CBP to require a CV duty cash deposit equal to the following CV rates (as amended from the agency's final determination):
