China Garlic: Prelim Results of AD Admin Review

The Commerce Department on Nov. 29 released the preliminary results of its antidumping duty administrative review on fresh garlic from China (A-570-831). Rates calculated in this review will be used to set assessment rates for importers of subject merchandise from the exporters under review that was entered Nov. 1, 2019, through Oct. 31, 2020.

Only the exporters for which an administrative review was requested are still covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation “as entered” for entries during the period of review from all exporters for which a review was not requested (ADCVDWeb Message # 1237402).

In these preliminary results, Commerce is also ending the review for 15 companies that had their requests for review withdrawn: Hengshui Chaoran International Trade; Jining Greenstream Fruits & Vegetables Co., Ltd.; Jinxiang Wanxing Garlic Co., Ltd.; Laiwu Manhing Vegetables Fruits Corp.; Linyi Mingda Food Co., Ltd.; China Jiangsu International Economic Technical Cooperation Corporation; Hebei Holy Flame International; Jining Alpha Food Co. Ltd.; Jinxiang Qingtian Garlic Industries; Qingdao Maycarrier Import & Export Co., Ltd.; Qingdao Ritai Food Co., Ltd.; Shandong Happy Foods Co., Ltd.; Shijiazhuang Goodman Trading Co., Ltd.; Weifang Hongqiao International Logistics Co., Ltd.; and Yingxin (Wuqiang) International Trade.

Commerce has also preliminarily decided to also end the review for Zhengzhou Harmoni Spice Co., Ltd. because the agency found the request for its review, submitted by The Roots Farm Inc., was invalid. According to Commerce, Roots Farm has in the past made misrepresentations, including about its status as a domestic garlic grower and its connections to Chinese exporters.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following rates:

Commerce said it considers Jining Shunchang Import & Export Co., Ltd. and Jining Shunchang Food Co., Ltd., for which a review was requested and which did not preliminarily qualify for a separate rate, to be part of the China-wide entity, with a rate that is unchanged and not subject to review -- $4.71/kg.
