Aluminum Sheet: Commerce Issues AD Duty Final Determinations for 18 Countries

The Commerce Department issued its final determinations in the antidumping duty investigations on common alloy aluminum sheet from Bahrain (A-525-001), Brazil (A-351-854), Croatia (A-891-001), Egypt (A-729-803), Germany (A-428-849), India (A-533-895), Indonesia (A-560-835), Italy (A-475-842), Oman (A-523-814), Romania (A-485-809), Serbia (A-801-001), Slovenia (A-856-001), South Africa (A-791-825), Spain (A-469-820), Taiwan (A-583-867) and Turkey (A-489-839). Cash deposit rates set in these final determinations take effect March 8.

Commerce also issued negative final determinations for common alloy aluminum sheet from Greece (A-484-804) and South Korea (A-580-906), finding no dumping by exporters from those two countries. As a result, Commerce will end suspension of liquidation and refund all cash deposits collected in connection with its AD duty investigations on Greece and South Korea, and will not issue AD duty orders covering the two countries.

Commerce also calculated a zero percent AD duty rate for Manaksia Aluminium in its final determination for India, and for Laminazione Sottile in its final determination for Italy. As a result, they will be exempt from any AD duty order issued in connection with these respective investigations, and are not subject to suspension of liquidation or cash deposit requirement, though Manaksia Aluminium is still be subject to suspension of liquidation and cash deposit requirements under the concurrent countervailing duty investigation on common alloy aluminum sheet from India.

The next step is for the International Trade Commission to make its final injury determinations, currently scheduled for April 15, according to a Commerce fact sheet. If the ITC finds injury, Commerce will issue AD duty orders and duties will be made permanent. If the ITC finds no injury, the investigations will be terminated and all cash deposits will be refunded.

Commerce is also issuing its final determinations in the concurrent CV duty investigations on common alloy aluminum sheet from Bahrain, India and Turkey, setting CV rates at 6.44% for Bahraini exporters, 4.89% to 35.25% for Indian exporters and 2.56% to 4.34% for Turkish exporters (see 2103050027). The agency also issued a final negative CV duty determination for Brazil, and will not issue a CV duty order for that country.

Critical Circumstances for Some Exporters, Cash Deposits Still Retroactive 90 Days

Commerce continued to find that all exporters of subject merchandise in Indonesia increased their exports to the U.S. in the months before the preliminary determination of the Indonesia investigation. As a result of this “critical circumstances” finding, Commerce continues to retroactively suspend liquidation and require AD duty cash deposits for subject merchandise from these companies as of 90 days before the preliminary determination, i.e., July 17. Otherwise, AD duty suspension of liquidation and cash deposit requirements remain in effect for entries on or after Oct. 15.

Commerce will instruct CBP to continue to suspend liquidation for AD duty purposes and collect cash deposits for subject merchandise entered on or after the dates listed below, and set cash deposit rates as follows, beginning March 8:
