China Cased Pencils: Final Results of AD Admin Review

The Commerce Department issued the final results of the antidumping duty administrative review on cased pencils from China (A-570-827). Commerce found two of the three companies remaining under review -- Tianjin Tonghe Stationery Industrial Co. Ltd. and Ningbo Homey Union Co., Ltd. -- did not demonstrate independence from state control, assigning them the China-wide AD duty rate of 114.9%. Commerce will assess AD duties at this rate on subject merchandise from Tianjin Tonghe and Ningbo Homey Union entered between Dec. 1, 2015, and Nov. 30, 2016. A 114.9% AD duty cash deposit rate for Tianjin Tonghe and Ningbo Homey Union takes effect for each company on Jan. 23.

Commerce also found Wah Yuen Stationery Co. Ltd. and its affiliate Shandong Wah Yuen Stationery Co. Ltd. did not have any bona fide shipments to the U.S. during the period of review, so its AD duty rate will not change. Any entries under its case numbers during the period Dec. 1, 2015, through Nov. 30, 2016, will be assessed AD duties at the 114.9% China-wide rate.

Additionally, for any other exporters of subject merchandise that were not under review (i.e., all exporters of subject merchandise except the three companies listed above), cash deposit rates will also remain at the level set in the most recent review of each respective company. For companies that have never been assigned a cash deposit rate by Commerce, the China-wide rate applies.
