The next step is for the International Trade Commission to make its final injury determination, currently scheduled for Dec. 21. If the ITC finds injury, Commerce will issue an AD duty order and duties will be made permanent. If the ITC finds no injury, the investigation will be terminated and all cash deposits will be refunded.
Commerce also issued its final countervailing duty determination on softwood hardwood plywood (see 1711150037). Liquidation is currently not suspended in that investigation due to the expiration of the four-month "provisional measures" period during which duties can be imposed without an affirmative final ITC injury finding.
In this final determination, Commerce assigned Linyi Chengen an AD rate of 183.36%, after having assigned the company a zero rate in its preliminary determination. As a result, Commerce will direct CBP to suspend liquidation for AD duty purposes for subject merchandise from Linyi Chengen entered on or after Nov. 16, 2017.
Scope Exemptions Confirmed in Final Determination
Commerce finalized several exemptions from AD/CV duties on hardwood plywood, including for finished table tops and countertops, furniture kits and laminated veneer lumber door and window components. It also finalized decisions not to exempt grooved wall paneling, drawer sides, “low-grade” plywood, utility panels and underlayment panels and furniture parts. Though it didn't add language exempting finished consumer products and consumer products kits, the agency clarified that they are "not subject to the scope of the investigations."
Commerce also removed several tariff schedule subheadings that cover plywood with both outer veneers of softwood lumber, which is not subject to these AD/CVD investigations, as follows: 4412.39.4011; 4412.39.4012; 4412.39.4019; 4412.39.4031; 4412.39.4032; 4412.39.4039; 4412.39.4051; 4412.39.4052; 4412.39.4059; 4412.39.4061; 4412.39.4062; 4412.39.4069; 4412.39.5010; 4412.39.5030; 4412.39.5050.
Estimated AD Cash Deposit Rates
Commerce will instruct CBP to continue to suspend liquidation of subject merchandise entered on or after the dates listed below, and require an AD duty cash deposit equal to the following AD rates beginning Nov. 16:
Exporter | Producer | AD Rate | Cash Deposit | Sus. Liq. |
---|---|---|---|---|
Linyi Chengen Import and Export Co., Ltd. | Linyi Dongfangjuxin Wood Co., Ltd. | 183.36% (from zero) | 171.55% | 11/16/17 |
Average rate (applies to over 400 companies) | 183.36% (from 57.36%) | 171.55% | 06/23/17 | |
China-wide entity | 183.36% | 183.36% | 03/25/17 |
Average rate companies. Commerce calculated a separate antidumping rate for hundreds of combinations of Chinese producers and exporters that demonstrated independence from state control, but were not individually reviewed in this investigation. See Commerce's notice for a full list.
China-wide entity. The China-wide entity includes, among others, Shandong Dongfang Bayley Wood Co., Ltd., which Commerce found did not demonstrate independence from state control and eligibility for a separate rate.
(The period of investigation is 04/01/16 -- 09/30/16. See Commerce’s notice for more information, including the scope of the investigation, detailed instructions on cash deposit rates, etc. See 1706220016 for a summary of the preliminary determination of this investigation.)
