CBP Clarifies Treatment of ACE Data for Merged Accounts
Merging ACE accounts does not result in the loss of any historical data, a CBP spokesman said in a recent email in response to a law firm's blog post on the subject (see 1710130025). CBP said it wanted "to correct and clarify the information in the Baker McKenzie blog" on how historical ACE data is handled once ACE accounts are merged following a company merger or acquisition. Specifically, "the ACE Portal merge feature does not create a new account, it consolidates data under the acquiring company’s account," it said. Also, "no historical transactional data from the acquired company is deleted or eliminated from ACE" and "CBP makes access solely available to the acquiring company."

For users of the acquired company to gain access to the data, "they will have to go through the Account Owner of the acquiring company," the agency said. "The acquiring company’s account identifiers will not be reflected on the acquired companies’ historical transactions." CBP also offered a reminder to "the trade of their recordkeeping obligations to maintain their records in their system or files. In preparation for an anticipated merger, CBP advises the company being acquired to store their information in paper or on their own server while they have readily available access to their accounts." The agency plans to provide this information in coming communications, it said.
