China Innerspring Units: Final Results of AD Admin Review
The Commerce Department issued the final results of the antidumping duty administrative review on uncovered innerspring units from China (A-570-928) (here). Commerce found both companies under review, East Grace Corporation and Macao Commercial and Industrial Spring Mattress Manufacturer, did not demonstrate independence from state control, assigning the companies the China-wide AD duty rate of 234.51%. Commerce will assess AD duties at this rate on subject merchandise from East Grace or Macao Commercial entered between Feb. 1, 2014, and Jan. 31, 2015. A 234.51% AD duty cash deposit rate for each of these companies takes effect Sept. 12.

Commerce denied a request from a domestic manufacturer that it also find that all innerspring units exported by Macao Commercial originate in China and should therefore be subject to AD duties. "However, the information placed on the record during this administrative review as well as prior circumvention findings in this proceeding raise a concern that there are entries which should be subject" to duties "but currently are not," it said. Commerce "intends to consider these facts to determine if it would be appropriate for [Commerce] to self-initiate a circumvention inquiry."
For any other exporters of subject merchandise that were not under review (i.e., all exporters of subject merchandise except East Grace and Macao Commercial), cash deposit rates will remain at the level set in the most recent review of each respective company. For companies that have never been assigned a cash deposit rate by Commerce, the China-wide rate applies.
