Vietnam Shrimp: Commerce Exempts Minh Phu From AD Duties

The Minh Phu Group will be exempt from antidumping duties on frozen warmwater shrimp from Vietnam (A-552-802) beginning on July 18, 2016, the Commerce Department said in a notice (here). Starting on that date, subject merchandise produced and exported by Minh Phu Group and its affiliates will no longer be subject to suspension of liquidation and cash deposit requirements under the Vietnam shrimp order, and importers of subject merchandise from Minh Phu will no longer be subject to AD duty assessments calculated in annual administrative reviews. The partial revocation implements a deal reached with Vietnam to settle a dispute over U.S. antidumping duties at the World Trade Organization (see 1607180043).

Companies no longer subject to duties on Vietnamese shrimp as a result of this are Minh Phu Seafood Export Import Corporation and its affiliates Minh Qui Seafood Co., Ltd. and Minh Phat Seafood Co., Ltd. Other names used by the Minh Phu Group include Minh Phu Seafood Corp.; Minh Phu Seafood Corporation; Minh Phu Seafood Pte; Minh Qui Seafood; Minh Qui Seafood Co., Ltd.; Minh Qui; Minh Phat Seafood Co., Ltd.; Minh Phat; Minh Phat Seafood; Minh Phat Seafood Corp.; Minh Phu Hau Giang Seafood Joint Stock Company; Minh Phu Hau Giang Seafood Co., Ltd.; Minh Phu Hau Giang Seafood Corp.; and Minh Phu Hau Giang Seafood Processing Co., Ltd. The exemption applies only to shrimp both produced and exported by some combination of these companies.

Importers of shrimp produced and exported by the Minh Phu Group will have to submit a certification to show their merchandise is not subject to the Vietnam shrimp order. The text of the certification will be detailed in a message from Commerce to CBP that will be included in International Trade Today’s daily list of AD and CV messages. Only importers of record, not customs brokers, are allowed to make the certification. Importers will have to maintain documentation to support their claims.

Commerce will also order CBP to liquidate all shrimp from Vietnam produced and exported by Minh Phu Group, imported by Mseafood Corporation, and entered Feb. 1, 2014, through July 17, 2016, without assessing AD duties, except for such merchandise entered Feb. 1, 2016, through May 3, 2016, which will be liquidated at the cash deposit rate in effect at the time of entry, the agency said in a separate notice (here). All other shrimp from Vietnam produced and exported by Minh Phu and entered Feb. 1, 2014, through July 17, 2016, will be liquidated at the cash deposit rate in effect at time of entry.
