China Shrimp: Final Results of AD Admin Review

The Commerce Department issued the final results of the antidumping duty administrative review on frozen warmwater shrimp from China (A-570-893) (here), assigning Smart Foods and 57 other companies the high "China-wide" rate. Rates for all other Chinese exporters remain unchanged. These final results will be used to set assessments of AD duties on importers for entries between Feb. 1, 2013 and Jan. 31, 2014.

New Cash Deposit Rates Take Effect Dec. 18

Commerce assigned the only individually investigated company, Rizhao Smart Foods Co., Ltd., to the China-wide entity. Companies that didn't get a rate in this review will continue to get the cash deposit rate set in the most recent previous administrative review, and companies that have never been assigned an AD rate will get the China-wide rate. Rates are as follows:

ExporterAD Rate
China-wide rate*112.81%

*The China-wide rate also applies to 57 other companies that purportedly did not prove independence from government control. See Commerce's notice for a full list.

Assessment Rates For Entries February 2013 - January 2014

Commerce is using the rates it calculated in these final results to calculate assessments of AD duties on importers of subject merchandise for entries between Feb. 1, 2013 and Jan. 31, 2014. For entries exported by the China-wide companies, including Smart Foods, the agency will assess AD duties at the 112.81% China-wide rate. Any entries of subject merchandise claiming Shantou Yuexing Enterprise Company or Zhanjiang Regal Integrated Marine Resources Co., Ltd. as the exporter will also be assessed duties at the China-wide rate, because each of those two companies reported no shipments to the U.S. during the period of review.

(The review period is 02/01/13 -- 01/31/14. See Commerce's notice for more information, including the scope of the order, detailed cash deposit and assessment instructions, etc. See 14091111 for summary of the preliminary results of this administrative review.)
