China Chlorinated Isocyanurates: Details of CV Duty Order

The Commerce Department issued a countervailing duty order on chlorinated isocyanurates from China (A-583-850) (here). Because of the ITC's finding that there is a threat of injury to U.S. industry, but no actual injury at this moment, any CV duty cash deposits collected before Nov. 7 are being refunded.

With the issuance of this order, CV duties on chlorinated isocyanurates from China become permanent, and can only be ended under certain conditions, like a sunset review or a changed circumstances review. Commerce will now begin conducting annual CV duty administrative reviews on chlorinated isocyanurates from China, if requested, to determine final assessments of CV duties and make changes to CV duty cash deposit rates. Chlorinated isocyanurates have been subject to an antidumping duty order since 2005.

Refunds of Cash Deposits Collected Before Nov. 7

Because the ITC only found a threat of injury to U.S. industry, duties can only be assessed on chlorinated isocanurates from China entered on or after the date of the ITC's injury determination. Commerce says it will instruct CBP to refund CV duty cash deposits collected between Feb. 24 and June 23, the day before the ITC's final injury determination. No CV duty cash deposits were collected between June 24 and Nov. 6, because of the expiration of the "provisional measures" period.

CV Suspension of Liq Instructions

Suspension of liquidation resumes for all entries of subject merchandise from China entered on or after Nov. 7, the date of the ITC's final injury determination.

CV Cash Deposit Instructions

A CV cash deposit requirement is also in effect for subject merchandise from China entered on or after Nov. 7. Commerce will instruct CBP to require, at the same time as importers deposit estimated duties, a cash deposit equal to the CV duty rates listed below:
