China Refined Copper Pipe: Luvata 'Unilloy' Tubes Not Subject to AD Duties

High-strength “Unilloy” copper alloy tubes manufactured by Luvata Tube (Zhongshan) Ltd. are not made of refined copper, and so aren’t subject to antidumping duties on seamless refined copper pipe and tube from China (A-570-964), said the Commerce Department in a Sept. 16 final scope ruling. Despite meeting dimensional requirements set forth in the scope, the tubes contain under 99.85% copper and over 0.3% nickel. That runs contrary to the scope’s definition of refined copper, Commerce said. With the question of AD duty coverage decided by the plain language of the scope, Commerce found it unnecessary to look to other factors, and ruled that the Unilloy tubes are outside of the scope of the AD duty order on seamless copper pipe and tube from China.
