China Aluminum Extrusions: Portable A/C Air Direction Assembly Not Subject to AD/CV Duties
Port-a-Cool’s aluminum louvers are finished assemblies (not parts), and so are not subject to antidumping and countervailing duties on aluminum extrusions from China (A-570-967/C-570-968), said the Commerce Department in a final scope ruling Sept. 9. The louvers are used to direct airflow from Port-a-Cool’s portable cooling unit. The louvers need no more processing in the U.S., and aren’t part of a larger assembly, Commerce said.

A louver is an adjustable vent that allows adjustment of airflow to be more concentrated or dispersed. Port-a-Cool’s louver is used in conjunction with a model of portable cooling units. The louver is imported from China separately from the rest of the cooling unit, and is installed on the unit after importation. They undergo no further manufacturing in the United States. Port-a-Cool or the downstream user only needs to screw the louver into the cooling unit.
The scope of the AD/CVD orders on aluminum extrusions from China excludes “finished merchandise containing aluminum extrusions as parts that are fully and permanently assembled and completed at the time of entry.” Port-a-Cool’s louvers qualify for that exception, Commerce said. They are finished and ready for use, needing no more processing once imported into the U.S. And they are not a part of the cooling unit, because the cooling unit would function on its own without the louver.
