India Frozen Warmwater Shrimp: ITA says Apex Frozen Foods is Successor-in-Interest

The International Trade Administration determined that Apex Frozen Foods Private Limited is the successor-in-interest to Apex Exports in the final results of a changed circumstances review of the antidumping duty order on certain frozen warmwater shrimp from India (A-533-840). As a result, Apex Frozen Foods will be assigned New Zhongya’s AD rate of 2.51 percent, effective Dec. 11.

In the preliminary results of this changed circumstances review, the ITA said record evidence indicated that the company underwent a change from a partnership to a limited liability company and changed its name, but retained Apex Exports' management and organization structure, operations and production facilities, and supplier and customer relationships. The petitioners did not comment on the preliminary results, so the ITA made no changes in these final results.

The ITA will instruct CBP to suspend liquidation and collect a cash deposit at an AD rate of 2.51 percent on all shipments of the subject merchandise exported by Apex Frozen Foods and entered, or withdrawn from warehouse, for consumption on or after Dec. 11.
