AD/CV Admin Reviews Begin for Nails, Retail Bags, Woven Sacks, Etc.

The International Trade Administration initiated administrative reviews for certain firms subject to antidumping duty orders with August anniversary dates. The ITA intends to issue the final results of these reviews no later than Aug. 31, 2013.

Separate Rate Certifications/Applications for China and Vietnam

All firms listed in the ITA's notice that wish to either retain or receive separate-rate status in the administrative reviews involving non-market economy (NME) countries (China and Vietnam) must complete, as appropriate, either a Separate Rate Certification or a Separate Rate Application.

In order to demonstrate separate-rate eligibility, the ITA requires the China and Vietnam companies for whom a review was requested that were assigned a separate rate in the most recent segment of this proceeding in which they participated to certify that they continue to meet the criteria for obtaining a separate rate. Certifications are due 60 calendar days from after the publication of the notice (i.e. on or about Nov. 26).

Notices of No Sales During the Review Period

If a producer or exporter named in this notice of initiation had no exports, sales, or entries during the period of review, it must notify the ITA within 60 days of the publication of this notice in the Federal Register, i.e. on or about Nov. 26. (The ITA will consider rescinding the review only if the producer or exporter, as appropriate, submits a properly filed and timely statement certifying that it had no exports, sales, or entries of subject merchandise during the period of review.)

Respondent Selection

If the ITA limits the number of respondents for individual examination for administrative reviews, the ITA will select respondents based on CBP data during the period of investigation. Respondent selection will be made within 21 days of publication of this Federal Register notice; i.e. on or about Oct. 17. Comments regarding the CBP data and respondent selection should be filed within five days of placement of the CBP data on the record of the applicable review.
