ITC to Review ALJ's Finding, Vacates Part of No Violation in Polyimide Films Patent Investigation
The International Trade Commission determined to review an administrative law judge’s final initial determination that found no violation of section 337 in the ITC’s patent investigation of certain polyimide films, products containing same, and related methods (337-TA-772). At issue are respondent SKC’s flexible films used in making flexible printed circuits for various consumer electronic products such as cell phones and laptop computers. The ITC also vacated the ALJ’s finding that SKC did not violate some of complainant Kaneka Corporation’s patent claims, and will review, among other things, ALJ determinations on the domestic injury requirement, anticipation and obviousness, and infringement with respect to several of Kaneka’s patents. Comments are due to the ITC by Aug. 15.
