China Steel Wheels: Prelim Determination of CV Critical Circumstances
The International Trade Administration has made a preliminary affirmative determination of critical circumstances for "all other" companies (i.e., firms other than the three mandatory respondents1) in the countervailing duty investigation of steel wheels from China (C-570-974). The ITA found (i) countervailable subsidies that were inconsistent with the WTO Subsidies Agreement and (ii) massive imports in a relatively short period of time.

CV Suspension Retroactive 90 Days Prior to March 2
As a result, ITA will instruct U.S. Customs and Border Protection to suspend, with regard to the "all other" companies only, the liquidation of any unliquidated entries of subject steel wheels from China entered, or withdrawn from warehouse for consumption, on or after June 8, 2011, which is 90 days prior to the March 2, 2012 date of publication of the preliminary determination.
The ITA will make a final determination concerning critical circumstances for steel wheels from China when it makes its final countervailable subsidy determination in this investigation. (See ITA notice for additional information, including the scope of the investigation, etc.)
