ITC Votes to Institute Patent Investigation Against Elpida & Kingston DRAM Devices

The International Trade Commission has voted to institute a patent investigation of certain dynamic random access memory (DRAM) devices (337-TA-821). The products at issue in this investigation are synchronous DDR3 DRAM devices and modules containing the same.

The investigation is based on a complaint filed by Nanya Technology Corporation of Taiwan on November 21, 2011. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation in the U.S. and sale of certain DRAM devices that infringe patents asserted by Nanya Technology. The complainant requests that the ITC issue exclusion and cease and desist orders.

The ITC has identified the following as respondents in this investigation:

  • Elpida Memory, Inc., of Japan;
  • Elpida Memory (USA), Inc., of Sunnyvale, CA; and
  • Kingston Technology Co., Inc., of Fountain Valley, CA
